Until 2018, full sports betting was only legal in the United States in Nevada. Three other states – Oregon, Delaware, and Montana – were allowed to offer limited betting operations, but of those only Delaware was taking advantage of its legal status.
In May of 2018, the Supreme Court struck down the Professional and Amateur Sports Protection Act, better known as PASPA – making it possible for states to individually regulate sports betting.
The court case had been filed by the state of New Jersey; state officials believed it was unconstitutional for some states to be allowed to offer sports betting while others could not (the ones that were allowed to were grandfathered in because they had live betting prior to PASPA going into effect in 1993).
Today, sports betting is legal or moving towards legality in nearly half of all states, although most of those only allow sports betting in-person at casinos (or in some states, lottery vendors).
